Reject or Not to Reject that is the question

Hi Guys
I took delivery of a brand new P400e on 1st September 70 Plate
I had issue with parking sensors not working and Hybrid not working, could only drive in EV or Petrol not combined.
Dropped car back to dealer on 14th Sept, They fixed the parking sensors but they can’t seem to fix the Hybrid, they say next week the have a call scheduled with JLR and the Master Tech. but they have had the car longer now than me.
The Dealer says I can reject the car in the first 30 days but while the car is with them the days don’t continue, but my 30 days from collection is next week.

Do I
Reject the car get money back and order another one ? Might be months before new one available
They said they would try to source one in the network but there not much stock at present.

Do I wait for them to fix but from 30th my 30 days end but the dealer said they don’t count while it’s with them. It must be an odd fault buts it’s come out of the factory like it and they have not got any idea on the problem. May be go for some compensation like 2 services etc. But what if they don’t fix it for weeks ?

The dealer is trying, I have a loan car and offer to pay my fuel and monthly finance

any thoughts ?

Not heard of the 30 days right to reject stopping while the have the car ? Tesla Model Y - 2023

If the dealer fails to solve the problem after 3 separate attempts, you are legally allowed to reject the car as it clearly is not fit for purpose. This rule of law believe it or not is relevant up to 6 years from purchase.

I used it against a garage who sold a friend a secondhand car that wouldn't start more often than it did.

It was a fight, but they settled before it went to court, and she had had it 18 months before I got involved.

So the 30 day option might be the easiest, but do not think that it is your last chance.

I would however take the view that if LR don't know what the problem is, the chances of you enjoying he car is very slim, I'd get out of it now.

I have previously rejected a 2017 RRS. As frustrating as your situation sounds, I wouldn’t reject just yet. Assuming you still like the car give the dealer a chance to work with JLR to identify and resolve the issue. It will likely be a quick fix and then you can get on with enjoying your car.

S22(1) of the Consumer Rights Act 2015 allows for this:
Quote:
A consumer who has the short-term right to reject loses it if the time limit for exercising it passes without the consumer exercising it, unless the trader and the consumer agree that it may be exercised later.


There has to be an agreement for extension so I would want a written agreement from the dealer.

I think you should either reject or discuss with a lawyer. No one on here can help with the dispute and time is short. 2012 SDV6 - it's missing a couple of cylinders
2008 TDV8 - it was a labour of love and is much missed

I would write to the dealership, JLR and the finance company highlighting your issues and stating you reserve the right to reject the vehicle until the vehicle's issues have been proven to have been resolved (28 days trouble free?). MY17 RRS 4.4d V8 Autobiography - Aintree Green (also referred to on Topix as British Racing Green)

the dealer is fine to start the process of rejecting, just can’t find anywhere the right pausing while the dealer has the chance to repair. Even if is an extra week.

My initial reaction it to reject it. But I can see your dilemma. It could be just a simple electrical fault in a controller somewhere. Replaced it and all's well. Or it could be a rebuild of the entire power train...

Any promise you get from the dealer about extending their 30 day rule should be in writing. And when they say they've fixed it you should still be able to reject it if your gut says its not for you. Not sure if you could get a deal like that but perhaps worth asking?

I would reject now, my current car has had electrical issues with deployable side steps & SIM card readers since new, better now but still not 100% at 3 years old, dealer tried their best but had to threaten rejection at 3 months old to get things really sorted out, the issue is if you keep it & persevere but reject later, you have to pay something which for me was around£10k! After 3 months! They did say rejecting in the first month would have cost me nothing but only at the 3 month point, very naughty of them but I will not make the same mistake again!

Get it sent back & a new one ordered, I would insist they also give you a loaner foc during the wait.
