All parties in this case are breaking the law, the girl asking the landlord ( your mate ) to give her an eviction notice, on no legal basis, your mate for doing it, and you for allowing this to happen.

Save yourself a big headache and loss of rent and do it with a solicitor. Do it right....do it once..

Tenant / Landlord law can be very difficult and costly if not done to the letter of the law.

There are numerous notices that could be served, each with its own pitfalls and complications.

This case is not straightforward. I have been doing this for 15 years and my advice to you ( as per my earlier post ) use a

there are other forums for landlords, ones which have solicitors on the board to give advice

I would say you need to inform the tenants of the change of landlord officially, serve them the correct notice, under the correct housing act, for your type of AST, whether in term or periodic, get the tenants to pay you, or the council, which councils only normally do if the tenants in arrears with their landlord etc

If your not fully aware of things you need to do.

Have you sorted out your landlords Buildings/Contents Insurance
Kept records of payments received,
Issued receipts
kept expenditure records to offset tax declarations
Have the BOND been protected in a deposit scheme
If its a council "paper bond" do thye know your the new owner
Does the property have smoke alarms/CO2
does the property have a valid EPC,
Annual Gas Safety check,
Electrical Safety check,
is the property safe to live in (no loose carpets, trip hazards anything a tenant could injure themselves on
Has any electrical appliance, provided by you (or was included in the sale) been PAT tested

If your not sure on some of the answers above, you could be leaving yourself open to some rather hefty 4 or 5 figure fines

Good Luck with the Eviction process, but im sorry to say this isn't going to be straight forward, as the tenant looks to be wanting to play the system to get a larger property handed to her at others expense, as for your friend selling you a property with this potential storm

In answer to your question Stuart, EPC would needed to have been provided to a new tenant, if he was going relet the property, he should provide one to each new tenant, aswell as anyone who requests it when advertised.

insurance to cover his own back should anything happen at the property, to the property, the tenant or anyone visiting either and entering the property grounds.

Electrical safety, not mandatory as per the CP12 but he needs to make sure the property is electrically safe, if he didn't have one, again open to hefty fines or even imprisonment in a worst case scenario

Smoke alarms are a requirement in England and Wales, were battery powered are sufficient, unless your property is in Scotland were since 2007 a mains powered alarm is required when renting or installing replacement smoke alarms

Curious, I have never needed an EPC for letting purposes.

When buying and selling, nobody reads them anyway. Just a racket in my opinion.
