CSA, advice and help needed!

Hi guys and girls , was wondering if I could pick the brains of any one with experience in dealing with the CSA!

My ex has a CSA case against me, mainly because she wanted more money and there are good reasons that I was not going to give her extra!

The CSA have now given me a weekly figure to pay her which I'm happy to go with,BUT they are insisting on a back payment I find unfair. The case has gone on a year not from my fault, when they have requested payslip, accounts etc I have given the information ASAP but due to them dragging their heels the case has gone on!

They tell me that the will not budge on the back payment amount but I feel cheated as I've not created the back log problem.

So do I just pay, or shall I stamp my feet a little?

I don't have the lump sum they want, having the worst trading year I can remember. They know I have available credit on some cards but I'm trying to avoid cards at the moment as the interests a killer!

Specialist advice needed I think, but in my opinion, they cannot get or take what you have, they will not ask you to borrow I am sure.

If you have had a crappy year, assume your self employed or wn your wn business, put in new figures, your in the best position possible if you want to sort out what you pay.

Firstly, is your ex on benefits ? If she is then i can't see a way out of it Big Cry I f she isn't then get her to withdraw her claim against you with the csa by way of letter and then agree to pay her an amount directly into her bank account that you are both happy with, that way you have got records of any payments made to her, never give her cash payments without a receipt otherwise it will come back and bite you big time. In the letter to the csa you need to put in it that any back pay will be paid directly to your ex, again agree a suitable amount you and your ex are happy with all this assuming you ex isn't on benefits, i'm no expert but it worked for me. I told them I didn't have the lump sum, but they had already done a credit search and knew I had credit on cards even I had forgotten about!!!! And wanted to pay there and then, I told them to give me a week to sort my finances.
Didn't need to submit new figures they were crappy enough!

Think there being heavy handed and hoping I just pay, this may well be the case but it's the unjust of them taking the time to sort the situation that Censored me off!

ADY 555, she is on benefits I believe, even though she is mortgage free in a four bedroom house! She has not and never will be on talking terms with me, hence she has now chosen the CSA route. We have been divorced for 9 years and I have always contributed for my daughter, until she came to live with me for a while because her mum was giving her grief and going through a bad time with yet another divorce and more kids involved! Rant over.......ish

So do I just pay or argue that the CSA should have taken 6 months to sort this rather than the year so making the back payment higher! Couldn't have saved for it as I didn't know how much they wanted and also trying to keep my business etc

Doesn't seem right that they can force you into debt (at very high interest rates) to pay a debt. Cut up the credit cards and you can't get the credit then Very Happy
Seriously though I would seek legal advise on this one, if its their fault for the delay I can't see that they can force the issue for immediate payment, at the very least they should give you time to pay.

Get an accountant and show a bad year as the worst year ever and argue if you are forced to pay your future ability to support your kids is in jeopardy. Am sure you can come to a deal with the CSA rather than go into more debt. TDV8 HSE, Remap (+45 BHP + 100 Nm), Taylored sport exhaust system by Pipe Werx

If you can prove payments made and the ex will agree that these have been made, they will deduct this, but if she will not verify it, then legal action will be needed.

Thanks for your replies guys, waiting for a brief to give me a call back.

@mike21 they have said i could pay off over a two year period by making my weekly payments higher, but that still means im paying for there incompitance

@sherlock already had a bad year, good point about ability to pay in future.

@Cavham Have made all payments through the CSA as requested by my ex, wouldnt pay her direct because she would deny ever recieving it, did you take advice from a lawyer?


Still open to other experiences/opinions if you have them?

If the back pay is a reasonable figure that is owed I don't think you have much choice but to pay (over a period of time), just because the CSA have delayed matters in calculating the figure I don't think they would give you a 'discount' because of their incompetence, indeed they would probably be entitled to charge interest! - unfair I know Big Cry

If, however you dispute the back pay amount you should do everything you can to get to a figure you are happy with taking into account all the problems they have caused you in delaying matters, your brief will be able to advise on what can and can't be taken into account when trying to reach a settlement with the CSA Thumbs Up 2019 BMW X3 2.0i M Sport in metalic black- Brilliant

In terms of you having credit available on credit cards, reduce your limit to whatever balance they are at and hey presto, no more available funds

Bang on, either dump a few of your cards, or reduce card to VERY low limit. In Spain - 2018 F Pace - Frightened away from the Sports due to crank failures
Gone - A couple of RRS, A couple of Disco's. However thinking of another Sport.

I can't offer any advice on payments or procedures, but my advice would be do whatever is the best for your daughter, if I was in your situation, I'd make sure she was the priority and was as unaffected as possible (I'm not saying she's not by the way Smile ). If you do that, then I would have thought that will dictate what sort of approach you take with the CSA Smile ON THE WAY: BMW F21 M140i

The thing is, if mother is on benefits and daddy is paying xyz to the csa Mr. Green the full amount payed by the father is kept by the csa and none of it is passed onto mother for the childs welfare because mother is already claiming maximum benefits, so the child is no better off unless daddy gives the child handouts directly, the maintenance payed to the csa just goes to help reduse the cost of running the country Mr. Green so where possible always try and avoid going down the csa route easier said than done with some ex partners i know.

I would have thought it would all revolve around what you can pay from what you earn, NOT what you can borrow????

The weekly figure they arrived at is back dated to when the claim was made, unfortunately! Non negotiable, as I understand Big Cry Big Cry Big Cry MY2010 3.0 TDV6 HSE, Zermatt silver/Ebony/walnut, privacy, side steps, rubber mats and standard otherwise...
