I bought mine from LR dealer brand new and after 9 weeks and umpteen different pieces of damage to the car they bought it back as they were only "fairly confident" they'd fixed the car at the 4th attempt. I did get an offer to be assisted into a new RRS but for all the assistance offered it was hardly worth it to be honest. That and the fact they couldn't get me a new car for months. Mine refused to replace it as I had had the car too long although my lawyer reckoned that they couldnt refuse to accept a rejection due to the faults being present for a few months.
The main problem you have here is that they kept fixing it and you kept accepting it back so you are seen to have "accepted the repairs" done to the car. But the next part is that they have had what is now "reasonable time" to effect the repair. I had a long conversation with my lawyer over this and they were the key phrases that you need to highlight to the dealer or simply get a solicitor to write to them as he/she will know which buttons to press to get a response. Current, M135i in Estoril Blue with more extras than the cast of Ben Hur.
