I have 2x sp30 from 2 years ago, and was given six points in my absence for refusing to name the driver of one of my vans which was caught by a camera. I will go and try to plead my case ,though I am not very hopeful. 08 HSE,5%TINTS, Factory tow bar, brum ,brum

I think even if you "remember" who was driving the van the offence is not filling the form in and the damage is done, theres no going back.

you could enlist the help of one of the specialist motoring solicitors.....depends how long the ban might be and if you can afford to be off the road for a bit?

I've stood there to plead my case , I know what it feels like and it's $h*t.

Some years back got done on M11 doing 110mph.

Travelled to court with a driver knowing a ban was coming my way.

Spoke to the clerk of the court, who said a ban was always the case, depended on how long.

My name was called out and entered the court room.

Got up and said my peice, and walked out with 6 points but no ban and a fairly small fine, which when paying to the clerk of the court, he could not beleive I had not been banned.

Followed this up couple years later with a careless driving charge being given an absolute discharge.

Funny thing also old Neil Kinnock got done shortly after me on M11 doing 101mph and he was given a 3 month ban.

My advice, walk in tall and proud, speak firmly, but with no emotion, state your case, but hte most important fact is this.

The court will not take into acount any hardship stories that effect you directly, lose a million a day, your house, kids, dogs and the shirt off your back, it doesn't count, but they will take into mitigation the hardship that is caused to others by the loss of your licence. EG mother needs twice weekly trips to hospital etc etc.
The court has to take into account hardship caused to others.

It is best not to lie outright, but re phrasing some facts, so they are not incorrect but convey a different meaning. In my case my mother who did need hospital treatment was presented as "My mother who lives with me" when in actual fact I was living in their house, not a lie but conveyed a different meaning.

Read this link above, bottom half more than the top, as has some intresting points in.

Will depend on what you have already done said, but found it intresting that the poilice only have the power under the relevant law to ask for the identity of the driver, you are NOT compelled to give an address or any other info.

Also some other stuff about it is not finite as long as due dillenge has beeen applied.

My mate got off without suppling a name as 3 different peaople were using that vechcile that day to do runs to the rubbish tip, but was unable to tie up time with driver, and that was accepted by court

When it comes to this, there's no sure fire way to get you off... and that's especially the case when a ban is up for consideration. Best bet is to sell a kidney and employ Nick Freeman, otherwise your best hope the court are in a good enough mood to like your story Wink

Thanks for your support guys , I have teken on a well known traffic lawyer, who for 2 grand reckons he can get me aquitted, he is going for an adjournement on Tuesday, while we get statements from all other employees, denying responsibility, then apparently , I will have taken reasonable steps to find out who the driver was, and have to be aquitted. I had the same problem of not disclosing the driver ,I advised the court it was one of my work vans and we were installing some CCTV in a car park ,the client asked all the tradesmen to leave their keys as vehicles may have to be moved .The court agreed and it stopped there. Thumbs Up

There is no way of knowing what you will get unfortunatley - it depends if the bloke / woman in front of you got any the night before. Mine clearly hadnt got any for weeks as I got 12 month ban (DD40 - Dangerous driving with excessive speed) made to retake test.

MIne was in excess of 100 on M1 Sad

I find it best to go in excess of 170mph (Not in the RRS though Big Cry )......as demonstrated on TG this is too fast for the cameras Cool
