F**king typical!

MOT time. Pull into MOT garage and apply the park brake. Squeal from the EPB and error time. Pulled the release and tried to relatch using IID bit to no avail. So it's going to fail on handbrake.

That and a damaged tyre yesterday - driven into one of this bits of rock people put in the highway verge outside their house - whilst avoiding a speeding van.

F**k it! 2012 SDV6 - it's missing a couple of cylinders

Garage can't do it, and provide a loan car, until 2 August. Just got to hope the EPB shoes don't jam in the drum before then. Will do about 1k miles before then... Confused I've put tape over the switch to prevent me trying the EPB again before the garage looks at it... 2012 SDV6 - it's missing a couple of cylinders

yes the old one covers it aslong as the tester hasn't put Dangerous at the side of the fail. Then it depends on how the plod look at it if you get pulled.

It just says "parking brake: efficiency below requirements". No mention of "dangerous" anywhere.

The refusal form says at the bottom: "If you intend to use your vehicle on the road you should have it repaired without delay and have it retested before the existing validity expires".

Problem is finding anyone who can sort an EPB at short notice. If it needs a new module then it's a biggish job needing a bit of time it seems.

Seems to me that an inefficient parking brake isn't dangerous. It's not as if the main brakes aren't working properly, for example.

I'm in a quandary now, that's for sure. 2012 SDV6 - it's missing a couple of cylinders

As I understood it the law hasn't changed its always been the case if the car fails then the old ticket becomes invalid. It just couldn't be enforced with the old paper system, but now it computerised then as mot fail says a quick check and they'ye got you.. 2008 G4 RRSport TDV8 current

One of my previous posts on the subject (the gov.uk site still states the same today):

Lost for Words wrote:
Yup, this has been argued over before.

My view is that the MOT certificate is not invalidated by a failed MOT, however, assuming the failure items are correct and accurate, your vehicle would/may still be considered unroadworthy and you would be deemed to be aware of this fact.

The reason I see for doing it this way, is that if you were to fix the highlighted issues, you are then roadworthy and legal again without the need for a new MOT until the existing one expires, or likewise, this way, an error made on an MOT doesn't make the vehicle illegal to drive.

As said, that is my view based on the information on the GOV.UK website:

Quote:
Driving a vehicle thats failed

You can take your vehicle away if your MOT certificate is still valid.

If your MOT has run out you can take your vehicle to:

have the failed defects fixed
a pre-arranged MOT test appointment

In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined.

Thumbs Up

The letter of the law concurs:

Quote:
Road Traffic Act 1988 Part II Section 48

(2)Where

(a)within the appropriate period after a test certificate is issued or treated for the purposes of section 47 of this Act as issued, but

(b)not earlier than one month before the end of that period,

a further test certificate is issued as respects the same vehicle, the further certificate shall be treated for the purposes of that section as if issued at the end of the appropriate period.

You are still legal to drive the vehicle,,that's why I put in my previous post,,have they put dangerous on the fail,,if not you are ok till your original mot runs out.if it fails say on service brakes & the tester has put dangerous at the side of the fail then you are driving a vehicle with known defects then you could be fined.
What would happen if someone brought a car to my place with 1 months mot remaining & I fail the vehicle, then the owner sells the car down the pub with I month mot left how would the buyer know if it had just failed without going online to check the vehicles history.

IT IS NEVER!!!! Legal to drive a car that has failed a Ministry of Transport test, EVER!

Can you square this with the law which I have quoted?

A car that has failed an MOT could legally be driven IF it is in a roadworthy condition. As a clear example, one could legally drive a car once repaired, without taking another test until the old MOT certificate has actually run out. Whether the lack of EPB amounts to an unroadworthy vehicle is open to opinion, but the statement you make is not in line with the law. The specific offence of driving without a valid MOT certificate cannot be committed until the old MOT has expired; others may apply, but not always. Thumbs Up Visiting from DISCO3.CO.UK
