Just received a call from them saying there is nothing we can do our warranty department keeps rejecting the claim . I asked to speak to them and was told they do not speak with customers the court fees will cost the same amount as repairing the engine and I don’t even have £15000 to spend on a engine right now

They act like a bunch of criminals. Figger out how to get the means to sue them.( you don’t have aan insurance that includes legal support? )
You should not only claim the engine , but also related cost, like transportation, lack of replacement car etc.
I guess you could warn them as well of the high judicial

sv1rk, that is shocking from LR, to say the least.

whether the failure occurred in Germany surely has no relevance to the extended warranty?

what engine is in your RRS? the 3.0 SDV6? --

Naks I don’t know what engine my car is it’s the 3.0 diesel I’m not sure if it’s a tdv6 or sdv6 is there a way to check ?

3.0 diesel is the SDV6.

Sounds like you've fallen victim to the dreaded crankshaft failure.

That is most unfortunate, and looks like you have a legal battle on your hands.

I found a recon engine and with part ex it costs me around £5000 but I have no idea on the mileage or any of the service history on the engine so I am unsure if I should go for it because it might make the car more un reliable

It can hardly be any more unreliable. I'd consider fixing it and then selling it if you've lost confidence.

If you can get the repair costs under £10k then you can sue them in the small claims court, which is minimal risk to yourself (as long as you keep it on the small claims track and don't add any other costs into the claim). RRS MY17 SDV6 AB

If the contract really states "all claims must be made in the united kingdom " then tell them, you ARE in the United Kingdom and are making the claim from there.
It sounds ludicrous but if that is that exact wording then any solicitor worth their salt would rip them apart on this.

If the warranty company are refusing to pay up then claim from the garage you bought the car from,,when I sold my14 sdv6 & the crank failed with 2 weeks of the new owner getting it,,i contacted LRCS who said is is nothing to do with them as a indie dealer was involved & the new owner should chase them for the repairs.

I’d ring the warranty company as a ‘new customer’ and state you use the car on European holidays and would be interested to know if the cover (the same as you have) would cover you for a breakdown overseas. Just to see how it’s being sold! They will do anything for a sale so record everything.

On a tangent, a friend of my wife is having issues with a local dealer. The car they bought 6 months ago was supposed to have been RAC approved, RAC warranty and RAC recovery. When the car broke down they rang the RAC who had no record of their vehicle. It would appear the dealer has been frodulent and sold the car as having this RAC cover when in fact it didn’t. The solicitors are now involved so it will be interesting to see what happens next. I just wonder how often dealers do mis sell things, misleading us into believing we are buying a secure product. 2012 5.0 SC AB

Who provides the warranty and does it have a product name? I'm interested in reading the full terms & conditions.

Germany is in Europe, so saying that because the failure happened there and then claim is [now] being made in the UK it is not covered... I think they are on thin ice and certain terms may be rejected by the court.

I would contact a consumer advice process, like you see in Telegraph and other newspapers and get them involved. It's a newsworthy topic and they are very influential.

Finally, you are covered by the Consumer Goods Act 2015, see https://www.citizensadvice.org.uk/about-us...-act-2015/



The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the 'expected lifespan' of your product you can have a full refund or replacement within the first 6 months, or within 6 years entitled to 'some money back'. In my view, a car with this mileage is within its expected lifespan and an engine failure implies the car was not of satisfactory quality, so there is definitely some scope for financial compensation.

1. Tell the finance company asap.
2. Contact Citizens Advice Bureau for some free legal advice.
3. Use the above two to help you craft a letter to the car dealer. L405 P400e Autobiography (MY2020)... Silicon Silver / Espresso
