Well that didn't last long problems

Bought my 2005 RRS HSE in December from a RAC approved dealer before I took delivery they did a full engine service replaced the timing belts and put it through an MOT. Noticed a vibration in the steering at over 60 mph and what I can only describe as a rotational droning noise, so took it to my indy who put it on the ramps and has found the following.
Rear prop centre bearing disintegrated
NSF wheel bearing has play in it you can feel and hear it knocking
Both rear drop links worn ARB
And there is play in the rear bushes
As the vehicle was sold with a new MOT ( the tester must have been blind or didn't give a Censored according to my mechanic ) am I right in thinking it's down to the dealer to put these problems right and am I best conducting all communication via email so I have a record. This is the first time in years I've bought from a dealer so not sure of the procedure now. If it ain't broken down it soon will

Yep, back to the dealer with a list of your problems... start quoting consumer rights act and you could also mention a report to VOSA with the findings post MOT. You’ve been sold an unsafe car, make it clear you’re very unhappy and want everything repaired at the dealers cost.

I did the same when I found problems within the first 6 weeks, Evans Halshaw to their credit, obliged and paid for all of the faults to be fixed.

Emails are the way to go but in the first instance, a telephone call or face to face chat, backed by a confirmation email, should be your first move.

Thought I had a claim against the dealer Thumbs Up just it's 20 years since I've bought a car through a dealer, always bought privately but I couldn't find the car I wanted so had to get one from a dealer. If it ain't broken down it soon will

Phoned the dealer today told him about the faults found, after a trip to the garage they us he's agreed to repair all the faults at his cost Thumbs Up goes in in 2 weeks. If it ain't broken down it soon will

Yes, good news the dealer is standing by its obligation, especially as the car was serviced and MOT’d so recently.
Just goes to show a buyer has a right to expect no serious faults within a short period after a purchase, especially if it was advertised in ‘excellent’ condition or if faults were not pointed out during a test drive.
Buyers cant all be expected to be mechanically minded and it’s down to the dealer to highlight potential issues and if this doesn’t happen, it can be assumed a car is being sold with no faults. It doesn’t matter how old the car is, or the mileage it has covered, the car has to be fit for purpose if being sold without specific problems mentioned in advertising or by the dealer prior to shaking hands on a deal.

If during a test drive a fault is discovered and a dealer replies along the lines of ‘well, it is a 10 yr old car and has covered xyz number of miles, what do you expect given the price in the window’ and isn’t prepared to repair the fault prior to sale, the responsibility is still on that dealer to note the fault on the invoice if the buyer remains happy to make the purchase. If the dealer doesn’t do this, it has no proof that conversation happened.

The law is very much on the side of the buyer in the first weeks after a purchase, which begs the question, what is the point of these silly offers of a free 3 month warranty etc, used dealers tend throw in. They serve no real purpose.

They do serve a purpose - for the seller, trying to shorten a buyer's legal rights.
